Retired Russian colonel convicted of spying for US

(AP) ? A retired Russian military officer has been convicted on charges of spying for the U.S. and sentenced to 12 years in prison, the counterintelligence agency said Thursday, the latest in a raft of espionage cases that come amid tensions between Moscow and Washington.

A court has ruled that retired Col. Vladimir Lazar will be sent to a high-security prison and stripped of his military rank, the Federal Security Service, or FSB, said in a statement.

Prosecutors said Lazar purchased several computer disks with more than 7,000 images of classified maps of Russia from a collector in 2008 and smuggled them to neighboring Belarus, where he gave them to an alleged American intelligence agent.

The FSB said the maps could be used for planning military operations against Russia. Lazar had served with the General Staff of the Russian armed forces in Moscow before his retirement in the early 2000s.

The FSB did not specify when the Moscow City Court's verdict and sentence were handed down. Prosecutors first reported charges against Lazar in April. Russian state television broadcast brief footage from the courtroom, showing the gray-haired, bespectacled Lazar sitting in a cage.

Earlier this month, a court in the Ural Mountains city of Yekaterinburg handed an eight-year prison sentence to Alexander Gniteyev, a defense company worker accused of passing information about Russia's latest missile, the Bulava, to a foreign intelligence agency.

And in February, Lt. Col. Vladimir Nesterets, who oversaw missile tests at the Plesetsk Launchpad in northern Russia, was convicted on charges of providing the CIA with secret information on new missiles and sentenced to 13 years in prison.

The series of spy trials come as U.S.-Russian relations have soured over U.S.-led NATO missile defense plans for Europe, which Moscow sees as a potential threat to its nuclear forces, and other disputes.

Vladimir Putin, re-elected to a third term in March, had taken a strongly anti-American posture during his campaign, accusing Washington of staging the mass protests against his 12-year rule in an effort to weaken Russia. Interestingly, as a commenter points out at MacRumours, which found the listing, the circuitry necessary for the second dock connector is still present in normal iPads, though there is no hole in the case through which it can be accessed.

The real question, of course, is how did this device get out of Apple's labs in the first place? The seller tells Wired: "Judging by how Apple works, it?s most likely stolen, but I?m not sure about that...?I can?t give much information about the Apple device without revealing who specifically I am." That may put this auction in questionable legal territory.

Regardless, the package is already in the open, in transit?to the US-based buyer. Apple may try to track it down, but this cat is already out of the bag.

We've been on the record that the overall structure and flexibility offered by leasing companies often far exceeds any rate differential in lease finance.

Objection # 3- You prefer loans. Well that may well be, but you are of course adding debt to the balance sheet under that scenario. Oh and by the way, when you choose a capital lease full payout scenario you are very close if not at the loan scenario. The true finance lease is essentially a loan for the full amount of the asset.

Objection # 4- You have had what our mentor called a ' bad experience '. Our point on this one is that you also may have a bad experience with a lawyer, accountant, or business or personal financial advisor. The reality is that you need to focus on partnering with a firm or individual that you trust when it comes to equipment lease financing in Canada. That goes for choosing a supplier, banker, etc. It's only common sense.

Objection # 5- Hell or high water. What? A Hell or high water clause in commercial leasing indicates that you are obligated to pay the full amount of all remaining payments in your transaction .What that, you want to change that clause. The reality is that with the proper negotiation a good lessor or leasing advisor has the ability to include in your transaction features that make sense to you when it comes to cancellation and pre-payment.

Objection # 6 - the proverbial down payment. You don't like it. Down payments with good credit quality are minimal or non existent when it comes to equipment lease financing as well as choosing the proper lessor.

Children exposed to the common pollutant naphthalene show signs of chromosomal damage

ScienceDaily (May 29, 2012) ? According to a new study, children exposed to high levels of the common air pollutant naphthalene are at increased risk for chromosomal aberrations (CAs), which have been previously associated with cancer. These include chromosomal translocations, a potentially more harmful and long-lasting subtype of CAs.

Researchers from the Columbia Center for Children's Environmental Health (CCCEH) at the Mailman School of Public Health, Columbia University Medical Center, and the Centers for Disease Control and Prevention (CDC) report the new findings in Cancer, Epidemiology, Biomarkers & Prevention, a journal of the American Association for Cancer Research.

Naphthalene is found in both outdoor and indoor urban air. It is present in automotive exhaust, tobacco smoke, and is the primary component of household mothball fumes. Classified as a possible carcinogen by the International Agency for Cancer Research, naphthalene belongs to a class of air pollutants called polycyclic aromatic hydrocarbons (PAH). Prior research at the CCCEH has established a link between prenatal exposure to PAH and increased risk for childhood obesity, IQ deficits, and CAs. The new study is the first to present evidence in humans of CAs, including translocations, associated with exposure to one specific PAH -- naphthalene -- during childhood.

The researchers followed 113 children, age 5, who are part of a larger cohort study in New York City. They assessed the children's exposure to naphthalene; a CDC laboratory measured levels of its metabolites -- 1- and 2-naphthol -- in urine samples. (Metabolites are products of the body's metabolism, and can serve as marker for the presence of a chemical.) Researchers also measured CAs in the children's white blood cells using a technique called fluorescent in situ hybridization. Chromosomal aberrations were present in 30 children; of these, 11 had translocations. With every doubling of levels of 1- and 2-naphthol, translocations were 1.55 and 1.92 times more likely, respectively, to occur.

CAs have been associated with increased cancer risk in adults. Translocations are of special concern as they result in a portion of one chromosome being juxtaposed to a portion of another chromosome, potentially scrambling the genetic script. "Translocations can persist for years after exposure. Some accumulated damage will be repaired, but not everyone's repair capacity is the same. Previous studies have suggested that chromosomal breaks can double an adult's lifetime risk for cancer, though implications for children are unknown," says first author Manuela A. Orjuela, MD, ScM, assistant professor of clinical environmental health sciences and pediatrics (oncology) at Columbia University Medical Center and a pediatric oncologist at NewYork-Presbyterian Morgan Stanley Children's Hospital.

To obtain a better sense of the long-term consequences of naphthalene exposure, Dr. Orjuela and other CCCEH investigators are following some of the children in the study as they reach fourth grade. While they expect to see further translocations, they do not expect to see any signs of cancer in the white blood cells. "So far, the translocations seem to be random, and there has been no evidence of the specific translocations that are known to be associated with leukemia. This is entirely expected; leukemia is very rare." Frederica Perera, DrPH, senior author on the paper, adds that "the findings provide yet more evidence of the vulnerability of the young child to carcinogenic air pollutants."

The researchers hypothesized that naphthalene exposure was primarily from mothballs, which can release high levels of the chemical. Furthermore, according to previous research, some Caribbean immigrant families use mothballs as an air freshener. Other important sources of naphthalene in indoor air are tobacco smoke, paint fumes, cooking, and heating. The new findings have implications beyond the urban environment as elevated levels of naphthalene metabolites have been documented in rural communities using biomass-burning stoves (coal, wood) -- another source of PAH exposure.

The research was supported by the National Institutes of Health (grants R01ES12732, U01CA159157, 5P01ES09600, R01 ES013163, P50 ES015905, 5RO1ES08977, RO1ES111158, RO1ES012468, an d P30 ES09089), the U.S. Environmental Protection Agency (STAR grants RD832096, R827027, 8260901, and RR00645), and the New York Community Trust.

Samsung Galaxy S III heading to T-Mobile U.S. on June 20?

The Samsung Galaxy S III is still real hot news, and quite rightly so. As we approach the impending international launch -- starting May 29 in case you forgot -- the big release date questions are still coming from eager Android fans in the US.?According to a rumor posted by?TmoNews,??for T-Mobile at least, the wait might not be too much longer.?

Apparently, the Pebble Blue variant of the Galaxy S III, in both 16GB and 32GB form, will be available from June 20. The 16GB Ceramic White version will then follow on July 11. This follows on from the leaked June 20 graphics showing availability north of the border in Canada. (And this latest leak also pegs the Galaxy Note for July 11, so there's that.)

Big disclaimer though folks as usual, this is a huge old scoop of rumor. Nothing short of what we'd expect with such a massive launch as this one. But Samsung did show off an enormous "U.S. in June" slide at the London keynote, so there is a possibility of there being something behind this one.?

Senator asks airlines to drop seat fee for kids

(AP) ? Sen. Charles Schumer is urging airlines to allow families with young children to sit together without paying extra.

The New York Democrat is reacting to an Associated Press story last week detailing how families this summer are going to find it harder to sit together without paying fees that can add up to hundreds of dollars over the original ticket price.

"Children need access to their parents and parents need access to their children," Schumer said in a statement. "Unnecessary airline fees shouldn't serve as a literal barrier between mother and child."

Since last year, American Airlines, Delta Air Lines, Frontier Airlines and United Airlines have increased the percent of seats they set aside for elite frequent fliers or customers willing to pay extra. Fees for the seats ? on the aisle, next to windows, or with more legroom ?vary, but typically cost $25 extra, each way.

Airlines are searching for more ways to raise revenue to offset rising fuel prices. Airfare alone typically doesn't cover the cost of operating a flight. In the past five years, airlines have added fees for checked baggage, watching TV, skipping security lines and boarding early. Fees for better seats have existed for a few years but have proliferated in the last 12 months.

Schumer is asking Transportation Secretary Ray LaHood to issue rules preventing airlines from charging parents more to sit next to kids. He is also asking the industry's trade group, Airlines for America, to persuade carriers to voluntarily waive the fee for families.

"A parent should not have to pay a premium to supervise and protect their child on an airplane," Schumer wrote in a letter expected to be sent Sunday to Nicholas E. Calio, the trade group's president.

The airlines say they try to keep parents and young children together. Gate agents will often ask passengers to voluntarily swap seats but airlines say they can't guarantee adjacent seats unless families book early or pay extra for the preferred seats.

Airlines have resisted past efforts by the government to further regulate them. Their argument: The cost associated with new rules would cripple an industry already struggling with thin profit margins.

Two years ago, Schumer got five big airlines to pledge that they wouldn't charge passengers to stow carry-on bags in overhead bins. The promise came after Spirit Airlines became the first U.S. carrier to levy such a fee.

W.Va. police find 4 bodies, hunt for suspect

West Virginia State Police said late Saturday they had found four bodies in a wooded area and believe they are those of a missing man, his girlfriend and his two young children.

Police said in a news release that the bodies were found about a mile from where the man's missing 2003 Chevy Venture van was discovered Friday night near Carl, in Nicholas County. Police suspected foul play based on the vehicle's condition.

The news release said that police found the bodies after executing a search warrant.

Authorities said they believe the bodies are those of Steven Hendrix; his girlfriend, Amber Martin; and his two young children, ages 6 and 4. They had not been seen since May 19; Hendrix's daughter, Cheyenne Hendrix, had reported the four missing May 21.

Police have identified James Roy Belknap as a suspect. His whereabouts were not known late Saturday. Police said he may be operating a white Ford F-150 or a Chevrolet Monte Carlo, color unknown.

A police spokesman could not immediately be reached for comment late Saturday..

(AP) ? A Texas man who took hostages in a northwestern Indiana realty office and held police at bay for several hours suffered three gunshot wounds before dying, likely from two different weapons, a coroner said Saturday.

Roy L. Ferguson, 48, of Fulshear, Texas, died at 6:30 p.m. Friday, Porter County Coroner Chuck Harris said. That was two hours after the end of the nearly seven-hour standoff at Prudential Executive Group Real Estate office in Valparaiso, about 40 miles southeast of Chicago.

"The likelihood of all three gunshot wounds coming from the same weapon is not good," Harris said. He said that wouldn't be confirmed until an autopsy is performed. It had not yet been scheduled because of Memorial Day weekend.

Valparaiso Police spokesman Sgt. Michael Grennes said Saturday that Ferguson had only one firearm ? a handgun. Grennes also said the SWAT officers who rushed inside the office after hearing gunshots at 4:30 p.m. did not fire on Ferguson, but officers exchanged gunfire with Ferguson when the standoff started.

Asked Saturday if police had shot Ferguson, Grennes said, "It's under investigation."

The Times of Munster posted a video report on its website showing police officers crawling through a window of a Valparaiso house owned and rented out by Ferguson to execute a search warrant. The newspaper said Ferguson moved to Texas about four years ago after his wife died.

"He didn't seem threatening or anything, you know, neighborly," Gregg Kovach, a neighbor, told The Times. "He was always out on his porch having a smoke or doing something out there."

Police received a 911 call around 10 a.m. Friday reporting a man with a gun had entered the brokerage office, Grennes said.

There were fewer than 10 people in the building when the incident began, he said.

One of them was accountant Carolyn Biesen. She was in her office when she heard a commotion near the front desk. Biesen walked out, saw a man standing over her injured co-worker on the ground and yelled at him to leave.

"That's when he pulled his gun out ? and pointed it in the air," she told The Associated Press late Friday, several hours after she and several other people were taken hostage.

Biesen, 51, retreated back into her office, locked herself in, shoved a file cabinet in front of the door and called 911. Curled up under her desk, she heard two gunshots, then several more in rapid succession.

Ferguson, police said later, was looking for someone he believed owed him money when he went into the Prudential Executive Group Real Estate office in Valparaiso on Friday morning.

Valparaiso Police Chief Michael Brickner said officers believe Ferguson shot himself twice in the head before SWAT members broke windows and stormed inside less than two hours after the last two hostages had been released unharmed.

"He has some history here," Brickner said of Ferguson.

An ambulance rushed Ferguson to a hospital, where he died, police said.

No hostages reported being shot, though Grennes said one person who was struck in the head was treated and released from a hospital.

Another witness, Randy Baker, said he was in an adjacent parking lot shoveling asphalt when an officer wielding a pistol suddenly ran by and asked if he'd seen or heard anything about a gun. When Baker said he hadn't, the officer approached the building.

Seconds later, the officer began rapidly firing at least half a dozen times, said Baker, who took cover behind his work truck. He said he saw a woman in a Prudential window cowering under an office desk.

"That's what really scared me," Baker said. "And I ran out of there fast."

Mack Elliott, an agent at the brokerage, wasn't in the office Friday but said he spoke with agents who were present. He believes the incident stemmed from a dispute over a real estate transaction.

Biesen, the accountant, said she didn't believe the gunman intended to hurt her.

"If he wanted to, he could have come right into the office ? maybe shooting through the door," she said.

Biesen spoke Friday night from her home, where several dozen family members and friends gathered after she had made it out unharmed. Despite the trauma, she said she felt sorry for the gunman, noting he could have decided to surrender after all the hostages were released.

"It's very sad," she said.

Chinese WTO suit strikes back at U.S. duties

GENEVA (Reuters) - China launched a complaint at the World Trade Organization on Friday against U.S. import duties on 22 Chinese products that the United States says are unfairly priced or subsidized, including solar panels and steel products.

"China firmly opposes the abuse of trade remedy measures and trade protectionism," China's Ministry of Commerce said in a statement.

China's complaint counterattacks in areas where the United States has hit Chinese products with punitive tariffs, known as anti-dumping duties or countervailing duties, in recent years.

In Washington, U.S. trade officials criticized Beijing for bringing the case because they said the U.S. Commerce Department was already working to address issues raised by China and which stem from an earlier WTO appellate panel ruling.

"China's resort to dispute settlement is premature and not an appropriate use of dispute settlement system resources," said Nkenge Harmon, a spokeswoman for the U.S. Trade Representative's office.

"This step by China suggests that China does not really care what the United States does; rather, China has determined without benefit of the facts that whatever the United States does will fall short of what China would like to see," Harmon said.

Beijing launched the action the same day that a WTO panel issued a confidential ruling in a high-stakes case aimed at prying open China's huge electronic payments market for U.S. firms like Visa, MasterCard and American Express.

The U.S. Trade Representative's office in Washington confirmed it had received the decision, but said it could not comment until it is made public in coming weeks.

Visa, MasterCard and American Express also declined comment on the case, which dates to late 2010 and challenges China UnionPay's domestic monopoly over electronic payment services.

The United States argues China failed to follow through on its commitment to allow foreign companies to offer electronic payments services by December 2006, five years after its entry into the World Trade Organization.

U.S. SAYS STUDYING COMPLAINT

China said its complaint covers exports worth $7.3 billion, encompassing diverse products like citric acid, kitchen shelving and lawn groomers. It also includes wind towers, even though the U.S. Commerce Department's preliminary decision on those wind tower imports is not due until Wednesday.

Eight days ago, the U.S. Commerce Department set punitive tariffs on Chinese solar panels, which it said Chinese exporters had dumped on the U.S. market at unfairly low prices.

The United States hit Chinese steel pipe imports with hefty anti-dumping duties in 2010. Later that year it launched a trade suit over Chinese government grants to wind power manufacturers, but it did not pursue the case.

Harmon said the Office of the U.S. Trade Representative was studying the complaint and would respond in accordance with WTO rules.

"The Obama administration strongly supports the trade remedy laws, and was the first administration ever to apply a 421 safeguard to imports from China," she said. A 421 safeguard is a U.S. measure that allows manufacturers to request emergency restrictions on Chinese imports in response to a surge.

COMPLAINT WON

Last year China won a WTO complaint, similar to Friday's, against U.S. duties on imports of Chinese steel pipes, off-road tires and woven sacks. U.S. Trade Representative Ron Kirk called that decision "a clear case of overreaching" by the judges.

Many of China's grievances might have been dealt with by a U.S. court decision last year, which struck down the Commerce Department's ability to impose countervailing duties on "non-market economies" like China.

But the U.S. Congress voted to restore it in March, ensuring U.S. duties on about two dozen Chinese goods stayed in place.

China's new complaint, the seventh it has filed against the United States since it joined the WTO in 2001, comes as WTO chief Pascal Lamy flies to China for a four-day visit, during which he will meet Vice Premier Wang Qishan.

The legal process begins with China holding talks with the United States to seek an amicable settlement.

It may move to arbitration if the two cannot agree, and the United States could be forced to scrap its duties and even compensate China if it is found to have broken the rules.

The dispute adds more heat to a trade relationship that has barely stopped simmering, even though the United States has seen signs of China "making progress" towards easing restrictions on its currency, one of the biggest causes of friction.

The U.S. Treasury again shied away from calling China a currency manipulator in its semi-annual report on Friday.

Although the overall pace of China's export growth has slumped to single digits this year, its trade surplus with the United States set a record of more than $295 billion in 2011, putting extra pressure on U.S. manufacturers whose markets are still recovering from the financial crisis.

Lamy has repeatedly warned that the world needs to be on guard against any rise of protectionism in the wake of the financial crisis, although the threat of a global trade war has not yet become reality.

U.S. and Chinese politicians also deny they are in a trade war, but global trade tensions are rising, with Latin America becoming an increasing focus of trade disputes. On Friday, one of the most heated disputes flared into a European Union suit over Argentina's import restrictions.

India, which launched a trade complaint over U.S. duties on steel last month, is also threatening to take the United States to the WTO over U.S. visa fees for high-skilled foreign workers.

The WTO is also expected to rule soon on another Chinese-U.S. trade dispute. The case involves Chinese duties on U.S. exports of a specialty steel product known as grain-oriented electrical steel that Washington says are unjustified.

(AP) ? Firefighters are battling a massive wildfire in southwestern New Mexico that has destroyed a dozen cabins and spread smoke across the state, prompting holiday weekend air-quality warnings.

The fire burned early Saturday through remote and rugged terrain around the Gila Wilderness and has grown to 85,000 acres or more than 130 square miles.

The heavy smoke apparently disoriented six hikers Friday, prompting the New Mexico National Guard to carry out a rescue.

Col. Michael Montoya said one of them had an injured knee and had to be taken to safety by ambulance. The others were able to walk to a secure area.

More than 500 firefighters are battling the blaze that resulted from the merger earlier this week of two lightning-sparked fires. Fire officials say nearly all of the growth has come in recent days due to relentless winds.

The blaze has destroyed 12 cabins and seven small outbuildings, and the privately owned ghost town of Mogollon was placed under a voluntary evacuation order.

The strong winds pushed ash from the blaze 35 to 40 miles away, while smoke from the giant fire spread across the state and into Arizona. The haze blocked views of the Sandia Mountains in Albuquerque, and a smell of smoke permeated the air throughout northern New Mexico.

Health officials as far away as Albuquerque and Santa Fe issued alerts for the holiday weekend, advising people to limit outdoor activities, keep windows closed.

They said the effects on most people would be minor but noted mild throat and eye irritation or allergy-like symptoms could be expected. Officials warned people with heart and lung conditions to be especially diligent in minimizing their exposure to the smoky air.

Meanwhile, in Colorado, officials said heavy air tankers and thousands of firefighters were on standby Friday as fire managers kept a close watch on high winds and hot temperatures at the start of Memorial Day weekend. Fire danger remains high in the southern Colorado foothills and the South Park area.

Two heavy air tankers have been taken to Grand Junction in western Colorado, where the fire danger is highest, U.S. Forest Service spokesman Steve Segin said.

"We've got the resources. We've got the firefighters," Segin said. "We're ready."

The National Weather Service said wind gusts could reach 70 mph Saturday in some western Colorado valleys, with sustained winds of 25 to 40 mph. Most of eastern Colorado also was under a high-wind watch, with sustained winds of 25 to 35 mph and gusts up to 55 mph possible Saturday.

In Southern California, firefighters worked to corral a wildfire that has chewed through 3,100 acres of tinder-dry grass and light brush since it broke out Thursday afternoon east of Julian.

On Friday, the fire forced about 50 people to evacuate an RV park in San Diego County. It earlier prompted the evacuation of about 100 homes in the Shelter Valley area, but residents were allowed to return late Thursday.

The fire was 20 percent contained, said Nick Schuler, battalion chief for the California Department of Forestry and Fire Protection. No injuries or damage to structures were reported.

In Arizona, residents of the historic mining town of Crown King were allowed to return home after being evacuated because of a wildfire about 85 miles north of Phoenix. The fire started May 13 and has burned more than 16,000 acres. It is 35 percent contained, fire officials said.

In Nevada, questions were being raised over fire crews' initial response to a backyard burn that rekindled two days later, destroying two homes in a rural community and scorching 7,500 acres.

A 911 recording obtained by The Associated Press showed a resident called Sunday to report that a neighbor's permitted burn in the Topaz Ranch Estates was out of control. Volunteer firefighters with the East Fork Fire Protection District arrived at the scene and then left, apparently without extinguishing the blaze.

Gusty winds rekindled the fire Tuesday, and it spread quickly through thick brush and dry grasses. Two homes and 17 outbuildings were destroyed.

District Fire Chief Tod Carlini did not immediately respond to messages seeking comment Friday.
